Suit Filed Against Policemen

A San Antonio man who claims his right foot was broken while he was being arrested by Kerrville policemen filed a lawsuit Monday in federal court here against the two arresting officers. Darryl Lane Lancaster filed the suit against A. W. McBeth, a policeman, and J. Harvey, a sergeant. The incident occurred about midnight last March 6 in Kerrville, according to the suit. Lancaster was arrested for allegedly driving while intoxicated, the suit says. Lancaster contends that McBeth "kicked and stepped" on his foot which broke two bones, causing him to be "immobilized with a cast from toe to hip for a period of six weeks." The local man claims he "did not resist" arrest and when he complained of a "serious and severe" pain in his foot, both officers refused to allow him any medical attention. Lancaster is asking $100,000 in damages.
